論我國司法鑒定人法律責任制度的完善
摘要
司法鑒定人的法律責任是指鑒定人在違反其法定義務或者在履行職責過程中給他人造成損失的情況下，所應承擔的法律責任。我國關于司法鑒定人法律責任制度的規定存在許多缺陷。針對這些缺陷，我們應在在責任主體方面明確司法鑒定人的責任主體地位；刑事責任上要完善偽證罪立法，并確立藐視法庭罪；民事責任上要正確定位鑒定人，明確鑒定人民事責任性質。行政責任方面則要加強立法，建立統1的法律規范。而且，要建立起切實可行的執業保險制度或執業互濟制度。保障司法鑒定人法律責任制度的有效完善和執行。

Abstract
Determiners responsibilty of law is the responsibilty of law that determiners should take in the situation of disobeying their obligation in law or causing loss to others in the proceeding of fullfill their duty. There are a lot of defects about the stipulates of determiners responsibilty of law system. Aiming at these defects, on responsible part, we should chang oragnation responsibilty to determiner (natural person) responsibilty; on penal responsibilty, we should improve legislation of perjury crime and establish contempt crime; on civil responsibilty, we should position the determiner correctly and identify the property of determiners civil responsibiltyclearly. On administration we should strengthen legislation and establish unified criterion of law. Further more, we should establish practical insurance system and mutual benefit system in carrying out business and ensure efficient improvement and implement.
