人權(quán)與國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)
摘 要
與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)協(xié)議的產(chǎn)生，在促進(jìn)知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)發(fā)展的同時(shí)，也造成了知識(shí)產(chǎn)權(quán)制度與國(guó)際人權(quán)法之間的沖突。從立法宗旨上講，不管對(duì)知識(shí)產(chǎn)權(quán)采用什么樣的措辭，知識(shí)產(chǎn)權(quán)保護(hù)應(yīng)與維護(hù)人類尊嚴(yán)和實(shí)現(xiàn)其他人權(quán)相1致。因此，我們必須開(kāi)展有關(guān)研究工作，探尋如何在包括TRIPS在內(nèi)的國(guó)際條約框架下，協(xié)調(diào)好知識(shí)產(chǎn)權(quán)與人權(quán)之間的沖突---價(jià)值連帶和制度互動(dòng)的問(wèn)題。具體說(shuō)來(lái)說(shuō)，知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)制度必須以國(guó)際人權(quán)公約的價(jià)值取向?yàn)橹笇?dǎo)，在保護(hù)公共健康權(quán)、隱私權(quán)等方面進(jìn)行制度改革。

ABSTRACT
The emergence of TRIPS is thought to promote the international protection of intellectual property while engender the conflicts between intellectual property system and internatinal human rights law.From the tenet of legislation,regardless of any experssions being used to intellectual property, the protection of intellectual property should be accorded with the protection of human dignity and realization of other human rights.Consequently, we must develop related research work to search how to harmonize the relationship between intellectual property and human rights under the framework of international treaties included in TRIPS---the problem of related value and mutual system.In details,the system of international protection of intellectual property must make public health,privacy,etc. under the direction of the value orientation of international pacts concerning human rights.
