　　CONSORTIUM AGREEMENT

　　甲方：Party A

　　乙方：Party B

　　丙方: Party C

　　甲方與乙方及丙方就招標編號為的招標項目投標有關(guān)事宜，經(jīng)各方充分協(xié)商一致，達成如下協(xié)議：

　　Party A,Party B and Party C fully agree on with respect to the bidding project No , and arrive at the following agreement:

　　一、由甲方牽頭，乙方和丙方參加，組成聯(lián)合體共同進行本招標項目的投標工作。

　　Party A as a leader, and Party B, Party C as members, form a CONSORTIUM to make a joint bidding for the project.

　　二、為本次投標的主體單位，聯(lián)合體以主體方的名義參加投標，聯(lián)合體中標后，聯(lián)合體各方共同與招標方簽訂合同，就本中標項目對招標方承擔連帶責任。

　　三、主體方負責等工作;參加方、負責工作。

　　四、負責等工作，具體工作范圍、內(nèi)容以合同為準。

　　五、各方對于分享項目成果和知識產(chǎn)權(quán)的`約定為：

　　七、各方的責任、權(quán)利、義務(wù)，在中標后經(jīng)各方協(xié)商后報招標方同意另行簽訂協(xié)議或合同。

　　The responsibility, right and obligation of members, consulting with each other on them and by agreement of the employer after award, are stated in further agreement or contract.

　　八、各方不得再以自己名義在本項目中單獨投標。聯(lián)合投標的項目責任人不能作為其它聯(lián)合體或單獨投標單位的項目組成員。因發(fā)生上述問題導(dǎo)致聯(lián)合體投標成為廢標，聯(lián)合體的其他成員可追究違約行為。

　　Each member shall not make a bid in this project in one’s own name. The leader shall not be a member of other CONSORTIUMS or solo bid party. If the CONSORTIUM bid becomes abandoned tender due to the problems above, other members of CONSORTIUM can take actions against his breach.

　　九、未中標，本協(xié)議自動廢止。

　　If the contract is not awarded to the CONSORTIUM, the agreement shall automatically be terminated.

　　投標聯(lián)合體授權(quán)主辦方協(xié)議書

　　The Agreement Authorized Leader by CONSORTIUM

　　(聯(lián)合體各方名稱)，，組成聯(lián)合體，參加招標編號為的項目共同投標，我單位現(xiàn)授權(quán)(聯(lián)合體主辦方名稱)為本投標聯(lián)合體主辦方，聯(lián)合體主辦方負責投標項目的一切組織、協(xié)調(diào)工作，并授權(quán)投標代理人以聯(lián)合體的名義參加項目的投標，代理人在投標、開標、評標、合同談判過程中所簽署的一切文件和處理與本次招標有關(guān)的一切事務(wù)，聯(lián)合體各方均予以承認并承擔法律責任。

　　本授權(quán)有效期至本次招投標有關(guān)事務(wù)結(jié)束止。

　　(The names of members), and form a CONSORTIUM, and make a joint bid for the project No , now we authorize XX (the name of CONSORTIUM) as the leader of CONSORTIUM and the leader is in charge of all organization and coordination work for bidding, and authorize tender agent to bid on the behalf of CONSORTIUM, and then all the members acknowledge and bear legal the liability for all documents signed and events dealt relating to the bid in the process of bidding, bid opening, bidding evaluation and contract negotiation by tender agent.

　　The authorization is valid until the related events of the bid ends.
